Choice DNA Laboratory LLC (“Choice DNA,” “Company,” “we,” “us,” or “our”) provides DNA testing services and related technologies. By accessing our website, purchasing services, or submitting biological samples or photographs, you agree to the following Terms and Conditions.

1. Definitions
   1 Choice DNA Laboratory LLC refers to Choice DNA Laboratory LLC and its authorized partners and laboratories.
   1.2 Client refers to any person or entity purchasing services or submitting biological samples or photographs.
   1.3 DNA Testing Services refers to laboratory analysis of biological samples including cheek swabs, blood samples, or forensic specimens used to determine genetic relationships.
   1.4 Facial Similarity Analysis Services refers to the comparison of visible facial characteristics using biometric software and computer vision technology. Facial Similarity Analysis evaluates visible facial features only, does not extract DNA, does not analyze genetic material, and cannot confirm biological relationships. Only laboratory DNA testing using biological samples can provide definitive genetic confirmation.
   1.5 Resellers or Affiliates refers to third-party businesses authorized to offer or facilitate services provided by Choice DNA Laboratory LLC.
2. Service Terms
   By purchasing or submitting materials for testing, the Client agrees to these Terms and Conditions. Choice DNA Laboratory LLC may utilize accredited third-party laboratories to perform DNA analysis. All submitted samples and materials become non-returnable once testing begins. Choice DNA Laboratory LLC does not guarantee that every submission will produce conclusive results. Turnaround times displayed on the website are estimated and may vary due to laboratory or scientific factors. Choice DNA Laboratory LLC reserves the right to refuse service at its discretion. Facial Similarity Analysis services are not intended for forensic identification, law enforcement use, or legal proof of identity.
3. Photo Submission Responsibility
   Clients submitting photographs or images to our services represent and warrant that they have the legal authority and appropriate consent from the individuals depicted in those images to submit them for analysis. The Client assumes full responsibility for the lawful submission of images and agrees to indemnify and hold harmless Choice DNA Laboratory LLC from claims arising from unauthorized submissions.
4. Technology Providers
   Certain services may use technology licensed from third-party providers including facial similarity software platforms. Choice DNA Laboratory LLC does not control the internal algorithms or technical processes of such technology providers.
5. Payments
   Full payment or an agreed deposit is required before services begin. Accepted payment methods include credit card, debit card, and other approved electronic payment methods. Personal checks are not accepted.
6. Refund Policy
   Refunds may be considered at the discretion of Choice DNA Laboratory LLC and may be subject to administrative and handling fees. Partial payments and deposits are non-refundable. If a payment is made in full and then the appointment is later canceled it will be subjected to a $25 cancellation fee for after birth DNA testing and a $200 non-refundable cancellation fee for non-invasive before birth prenatal testing. No refunds shall be issued if Services have been completed or if your DNA kit or supplies have been shipped. No refund shall be issued if cancellation of services is made more than 48 hours after payment. If the lab requires a sample recollection and the participant is unable or refuses to complete a recollection of the sample, no refund will be issued. Most recollections are needed due to low fetal DNA or testing conducted too early in pregnancy. Clients should be at least seven (7) weeks pregnant before considering prenatal testing. There is a $50 fee if a blood draw sample needs to be recollected from the mother. All DNA testing services have an estimated completion time listed online and can scientifically never be exact. Results are often finished earlier than expected but may exceed estimated expectations due to laboratory or scientific factors. Once testing is initiated, no refunds will be issued.
7. Warranties and Security
   Clients warrant that they are legally entitled to submit samples or photographs for testing. Choice DNA Laboratory LLC implements commercially reasonable safeguards to protect customer information, but no online system can guarantee complete security.
8. Disclaimers and Limitation of Liability
   Choice DNA Laboratory LLC DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Services are provided “as-is” without guarantees regarding specific outcomes. Choice DNA Laboratory LLC shall not be liable for indirect, incidental, special, punitive, or consequential damages. To the fullest extent permitted by law, the total liability of Choice DNA Laboratory LLC shall not exceed the amount paid by the Client for the service in question. Choice DNA Laboratory LLC shall not be responsible for representations made by resellers or third-party partners.
9. Emotional Impact Disclaimer
   DNA testing services may reveal unexpected or emotionally sensitive information, including the possibility of discovering non-paternity or previously unknown biological relationships. Clients acknowledge that such discoveries may have emotional, social, legal, or financial implications. Choice DNA Laboratory LLC is not responsible for emotional distress or consequences arising from such results.
10. Scientific and Technical Limitations
    Facial Similarity Analysis accuracy may be affected by lighting conditions, image quality, camera angle, aging, cosmetic procedures, and natural genetic variation. Facial Similarity Analysis compares visible facial characteristics and provides similarity estimates only. It does not analyze DNA and cannot confirm biological relationships.
11. Chain-of-Custody and Legal Testing
    DNA testing services may be offered as either legal chain-of-custody tests or informational (non-legal) tests. Legal DNA testing requires identity verification and supervised sample collection. Results from at-home or informational tests may not be admissible in court. Choice DNA Laboratory LLC is not responsible if a Client purchases a non-legal test and later attempts to use it in legal proceedings.
12. No Medical or Legal Advice
    Services provided by Choice DNA Laboratory LLC do not constitute medical advice, diagnosis, treatment, or legal advice. Clients should consult qualified professionals for medical or legal matters.
13. Fraud Prevention
    Fraudulent submissions or misuse of services will void results and payments.
14. Resellers and Affiliates
    Choice DNA Laboratory LLC may allow resellers or affiliates to offer services. Resellers operate as independent businesses and are not employees or agents of Choice DNA Laboratory LLC. Choice DNA Laboratory LLC is not responsible for disputes between resellers and their customers. Liability for services purchased through a reseller shall not exceed the amount paid to Choice DNA Laboratory LLC for the testing service.
15. Governing Law
    These Terms are governed by the laws of the State of Texas. Corporate governance matters shall be governed by the laws of the State of Indiana. Any disputes must be resolved in courts located in Tarrant County, Texas.
16. Updates
    Choice DNA Laboratory LLC may update these Terms periodically. Continued use of services constitutes acceptance of updated Terms.
